DMCA Policy for Yummy Recipes

1. Introduction Yummy Recipes (“we,” “our,” or “us”) respects the intellectual property rights of others and expects our users to do the same. In compliance with the Digital Millennium Copyright Act (DMCA), we have established the following policy to address claims of copyright infringement. If you believe that your copyrighted work has been copied in a way that constitutes infringement, please notify us as outlined below.

2. Notification of Copyright Infringement (DMCA Takedown Notice) If you believe that your work has been used on our Website in a way that constitutes copyright infringement, you or your authorized agent may send us a written DMCA Takedown Notice containing the following information:

A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that is allegedly infringed.
A description of the copyrighted work that you claim has been infringed.

Upon receiving a valid DMCA Takedown Notice, we will promptly remove or disable access to the allegedly infringing content and notify the user responsible for the content.

3. Counter-Notification of Copyright Infringement If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may submit a Counter-Notification to us. To be valid, the Counter-Notification must include the following:

Your physical or electronic signature.
Identification of the material that has been removed or to which access has been disabled, and the location where the material appeared before it was removed or disabled.
A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
Your name, mailing address, telephone number, and email address.
A statement that you consent to the jurisdiction of the federal district court for the judicial district in which you are located (or, if you are outside the United States, the jurisdiction of any judicial district in which we are located) and that you will accept service of process from the person who provided the original DMCA Takedown Notice or their agent.

Upon receiving a valid Counter-Notification, we will promptly forward it to the person who submitted the original DMCA Takedown Notice. If that party does not file a court action seeking an order to restrain the allegedly infringing activity within 10 business days, we will restore the removed material.

4. Repeat Infringers In accordance with the DMCA and other applicable laws, Yummy Recipes has adopted a policy of terminating, in appropriate circumstances, users who are deemed repeat infringers. We may also limit access to the Website and/or terminate the accounts of any users who infringe any intellectual property rights, whether or not there is repeat infringement.

5. False Claims Please note that under the DMCA, any person who knowingly materially misrepresents that content or activity is infringing may be subject to liability for damages (including costs and attorney’s fees). Filing a false DMCA Takedown Notice or Counter-Notification is a serious offense and could result in legal consequences.
